Change of Age Protocol
Friday 17th July 2026
Derbyshire County Council
Anthony Bek Community Primary & Nursery School
Consultation on a Proposal by the Governing Body for the Extension of the Age Range of the School from 5-11 years to 2-11 years
Context
We are a one form entry primary school with a PAN (pupil admission number) of 30 pupils in each year group. We also have a Governor led Nursery class with 15 hr and 30 hr places and can take a maximum of 30 children in each session (AM and PM). There is a demand for places for 2 yr olds in the local area. Many pupils join our Nursery significantly below expectations so extending the age range will enable school to identify, support and target their needs earlier.
Proposal
We are seeking funding from the Department for Education to redevelop our current Nursery building to be suitable for a 20 place 2 year old provision, redevelop our Y1/2 classrooms to move our current Nursery pupils into the same building as Reception to make a foundation unit and for a new building to house our displaced Y1/2 pupils. We are proposing to extend our Nursery provision from September 2027 to include 2 year olds.
We propose to enrol 20 children from the start of the term after they become 2 years old. In line with our 3 & 4 year olds Nursery, we will have three entry points one in September, January and April (or after the Easter holiday).
Staff
There will be no redundancies or reductions in staffing as a result of this change.
We have consulted with Derbyshire HR who have confirmed that no TUPE (Transfer of Undertakings -Protection of Employment- Regulations 2006) arrangements will be required. The Early Years lead will maintain overall leadership of the Early Years, including the 2 yr olds. Additional staff will be employed to work with the 2 yr olds with appropriate ratios, training and pay grades. Current staff will remain in their current roles but will also have an opportunity to apply for the roles working with 2 yr olds if they prefer.
Funding
This request is subject to the funding being provided in full by the Department for Education. If the funding application is unsuccessful, the age range will remain unchanged.
Consultation
The consultation on this proposal will be from Friday 17th July 2026 to Friday 18th September 2026.
